The primary registered guest must be at least 25 years of age.   As the primary registered guest, you are responsible for any expenses incurred during the visit, including - but not limited to - loss and/or damage, accident or injury to person or persons w/in the guest’s group or guest's visitors, or damages to the home, its contents, and the yard and gardens.

By signing the check-in registration form and entering the Octopus Garden Estate, you are accepting complete acknowledgment of - and adherence to - the policies and procedures as set forth below.  We recommend that you share these policies with all adult members of your group.

We are located @ 165 Pacific Street [off Hwy 101] just three miles north of Depoe Bay.  Call ahead as you are either leaving home - or when you arrive in our area, and we meet you at the Octopus Garden Estate to get you checked in.   We take down the vehicle license plate number for each car  [we have a strict limit of 3 cars]

No RVs are allowed.  However, secure off-street parking can be arranged for boats.  Please call to inquire. 

POLICIES:

Quiet Time:    
Quite time is from 10 pm to 8 am  [these times are monitored and strictly enforced]  This is a peaceful neighborhood with families and retirees, some of whom live here full time.  We ask that you respect our community quiet times.  Should we receive complaints about our guests [such as noise, illegal or indecent behavior(s), or trespassing], we will address the issue immediately with you.  If the behavior persists [ergo, if we receive more complaints after we’ve spoken with you], you will be required to vacate immediately, thus losing any unused rent as well as the deposit.

Occupancy:  
The Octopus Garden Estate accommodates up to 8 people.  Beds include:  1 King, 2 Queens, 1 Double Hidabed, and 1 Double futon.   If you exceed occupancy w/o prior approval, you may be assessed a fine  - or asked to vacate the the home.   Please call if you have any questions or special needs.

Keys:  
Should key(s) be lost during your stay, you will be charged for re-keying the home [the cost for this service is approximately $100].  We ask that, upon your departure, you give us a call @ 541-764-7576 so as to let us know that you are leaving and leave the keys by the phone.

Payments:  
The $200.00 Security Deposit is required at the time the home is reserved.  This is fully refundable as long as the home and its contents are left in good condition.  We require full payment for your stay (this to include rent, taxes, and cleaning fees) three weeks prior to your intended arrival unless booking within that 3 week period - in which case, payment in full is due at the time the reservation is made.  Payment is to be made by credit card via PayPal.  The Octopus Sculpture Garden is available for weddings or other special events for an additional $150.00 per event.  Please note that stays longer than one week may have additional fees/deposits and/or early payment requirements.   
          
Cancellations and Refunds: 
A cancellation fee of $40.00 goes into effect at the time you make your reservation. However, if you cancel after the full charges go on your card (so during that final 3 weeks before your stay), the cancellation fee will equal one night's rent plus tax.  Should you encounter an emergency, we attempt to work with you on rescheduling your stay in order to avoid cancellation fees.  This offer is only good if you reschedule within 6 months and will be applied only once.  There will be no refunds for late arrivals, for early departures, nor for the mechanical failure of non-essential items.  For stays longer than one week, special cancellation requirements apply.

Dog Policy: 
Octopus Garden Estate is now Dog-Friendly!   A $25.00 non-refundable Dog Fee will be charged for each dog with a limit of 2 dogs.   Fighting breeds are NOT welcome.  We also ask dog owners who bring their dogs to The Octopus Garden Estate to sign a "Dog Owner Statement of Responsibility" requiring that the owner pay for any damages incurred during their stay that cost more than the Security Deposit will cover.  Dogs staying at the Octopus Garden Estate must be fully housebroken/trained!    Should we discover a pet of any kind on the premises without prior approval and payment, you will be charged a $200 fine, will be told to vacate immediately, and any unused rents and the deposit will be forfeited.  Dogs only - No cats or other pets allowed.  You are expected to clean up after your dog(s).  We do charge clean-up fees for any debris left in the yard (including dog piles and garbage).  Dogs are NEVER to be left unattended in the home or yard at any time.

We are asking that visits to the sculpture garden are By Appointment Only, and dogs staying at the Octopus Garden Estate are NOT to enter the Octopus Garden (this is due to the delicate nature of the plants).   The home has a fenced-in back yard - separate from the sculpture garden - for visiting doggies :)

Smoking Policy:   
No smoking is allowed in the home.   We will charge a minimum $25.00 clean-up fee should garbage or cigarette butts be left in the yard.  Should smoking be detected in the home, you will be charged a $200 fine, and the security deposit will be forfeited.  This will be strictly enforced.
  
Octopus Garden Use:  
Use of the Octopus Sculpture Garden for an event requires a separate reservation (in addition to the house rental) and payment of $150.00 for the use of thesculpture garden.  Should you wish to rent the sculpture garden for an event, keep in mind that the home must be reserved as well.  The two-night minimum stay requirement applies.  Please call if you have questions regarding rental of the garden. 

Visits to the Octopus Sculpture Garden are By Appointment Only during your stay.  Visiting Doggies are asked NOT to enter the Octopus Garden due to the delicate nature of the plants growing there.   Please call our number (541-764-7576 or 541-921-8877) to make sure the garden is ready for visitors.  We ask that you use care when in the gardens due to the many exotic plants (many of which are dormant during winter months - and so are not readily visible), as well as the roots and other toe-grabbers that are part of this natural environment.  We are not responsible for injuries that may result from visits to the gardens.  Garden visits are not allowed after sunset, and, of course, NO SMOKING IS ALLOWED IN THE SCULPTURE GARDEN! 

Lost and Found Items:  
We charge a minimum of $15.00/postage for returning lost items.  We will hold lost/left items for 30 days only.  We will only return items at guest request.  Check the house carefully before departure to avoid these fees.
           
Campfire Policy:    
NO CAMPFIRES ALLOWED!   Violators will be charged a $500 fine, and will be required to vacate the home immediately.  This does mean you lose any unused rents as well as the deposit.

Fireworks Policy:
NO FIREWORKS ALLOWED at the home, gardens, or in the forest.  No Exceptions!!  If you use fireworks in these areas, you will be told to vacate the premises, any unused rents and your deposit will be forfeited!  This is a heavily wooded area and the home has cedar siding.  Fireworks are illegal on the beaches of Oregon!  ***You can, however, view fireworks displays on July 3 at Boiler Bay to the south, and on July 4 at Siletz Bay to the north.

BBQ Policy: 
We provide the charcoal for the BBQ (we provide a kettle BBQ for guest use).  No need to bring starter fluid to the home - we provide you with a Charcoal Igniter System that uses newspaper (provided) and a charcoal chimney - WITHOUT the use of dangerous, highly flammable, smelly fluids!    Please keep the BBQ pulled out at least three feet from the house and the deck (as well as away from trees) while in use - and until it has cooled down [this so as to avoid possible fire damage and injury to you and other members of your group].  DO NOT put the BBQ on the deck. 

Also please note that NO DEEP FRYERS ARE ALLOWED due to their inherent fire danger!   The home is equipped with a roasting pan for cooking turkeys, chickens or roasts in the oven. 

GENERAL POLICIES:

Length of Stay: 
The Octopus Garden requires a two-night minimum stay; Holidays require a three-night minimum stay.  Unless otherwise noted, Specials do not apply over holidays. 

Senior Discounts: For folks 55 and older, be sure to ask about our senior discount at the time you reserve.   Please note that the Octopus Garden is not an ADA accessible home, and all three bedrooms are on the second floor. 

Owner Requests:  The swinging bench on the back deck is for plants only – not for sitting.  Please avoid doing so.  **No Hair Dyes (or Clothing Dyes) are allowed in this home - no exceptions!**

Amenities: 
We provide the bedding, linens, dish/dishwasher/laundry detergents, toilet paper, paper towels, tissues, napkins, trash bags, liquid hand soaps, bath bars, and briquettes for the BBQ.  You will need to bring your food, clothing, and any special needs, goods, and/or equipment.  Additional toiletries may be purchased at the Sentry Market located just ½ mile south on Hwy 101.  There is also an IGA market located just six miles north in the Taft District of Lincoln City.

Beach Safety: 
We provide you with a tide chart at the home, however, Lincoln Beach is unpredictable and dynamic.  We often experience SNEAKER WAVES.   Children should never be left alone at the beach.  We strongly urge parents to remain near their children at all times while on the beach.
